1. Service Provider

These Terms and Conditions govern your use of the Viis Kolm data processing platform operated by Ophelius OÜ (registry code: 17292768, address: Järve põik 3-5, Elva linn 61504, Estonia). Contact: viiskolm@sauk.ee

2. The Service

Viis Kolm provides cloud-based data processing tools accessible via a web browser. Access is granted through time-limited tickets purchased via the shop. Each ticket grants access to a defined set of tools, a fixed number of processing runs, and a data retention period as specified at the time of purchase.

3. Purchases and Payments

All purchases are processed securely via PayPal. Prices are shown in EUR including VAT. A ticket is activated at the moment of redemption, not at the moment of purchase. The expiry clock starts when the ticket is first redeemed.

No refunds are offered once a ticket has been redeemed and a processing run has been initiated. Unredeemed tickets may be refunded within 14 days of purchase by contacting us at viiskolm@sauk.ee.

4. Your Data

Files you upload are processed solely to produce your requested output. They are deleted automatically at the end of the run's retention period, or immediately when you delete your account. Each tool run's retention period is equal to the ticket's retention period and starts when submitting the job. When the ticket's retention period or the maximum number of jobs is exhausted, no new jobs can be submitted, but existing jobs are retained until the end of their individual retention period. You retain full ownership of all data you upload and all results you download. By uploading data you confirm you have the right to process it and that it complies with applicable law, including GDPR where personal data is involved.

5. Acceptable Use

You agree not to:

• Upload data that you do not have the right to process
• Attempt to reverse-engineer, overload, or disrupt the platform
• Use the service for any unlawful purpose
• Share account credentials or ticket codes with unauthorised parties

We reserve the right to suspend access immediately if these conditions are breached, without refund.

6. Service Availability

We aim for high availability but do not guarantee uninterrupted service. Planned maintenance will be communicated by email where possible. We are not liable for losses caused by service interruptions.

7. Limitation of Liability

The service is provided as-is. We are not liable for any direct, indirect, or consequential damages arising from the use or inability to use the service, except where required by Estonian law. Our total liability in any case shall not exceed the amount paid for the relevant ticket.

8. Governing Law

These terms are governed by the laws of the Republic of Estonia. Disputes shall be resolved in the courts of Estonia, or alternatively through the Estonian Consumer Disputes Committee where applicable.

9. Changes to These Terms

We may update these terms from time to time. The current version is always published at this URL. Continued use of the service after the effective date constitutes acceptance of the updated terms.
